NPDES Overview

The National Pollutant Discharge Elimination System (NPDES) Permit program, created in 1972 under the Clean Water Act, is responsible for controlling and regulating point sources of discharge of pollutants to State Waters to maintain, protect, and restore the water quality of streams and lakes. The Clean Water Act limits the length of NPDES permits to five years. Point sources are discrete conveyances such as pipes or man-made ditches.

In 1990, Phase I of the NPDES storm water program was established.  It required NPDES permit coverage for large or medium municipalities that had populations of 100,000 or more.  Nine years later (1999), Phase II of the NPDES Storm water program was signed into law. This regulation builds upon the existing Phase I program by requiring smaller communities, also known as small municipal separate storm sewer systems (MS4s), to be permitted. Permits for regulated MS4s require the development, implementation and enforcement of a Storm Water Management Program that includes the following "six minimum control measures":

(1) public education and outreach on storm water impacts;
(2) public involvement/ participation;
(3) illicit discharge detection and elimination;
(4) construction site storm water runoff control
(5) post-construction storm water management in new development and redevelopment; and,
(6) pollution prevention/good housekeeping for municipal operations.

The Department of Environmental Services is the permittee for the City's MS4 NPDES Permit issued by the State of Hawaii Department of Health.
